Net ban has been lifted

DOn't know if yall have seen this, but on Nov 1 some idiot judge lifted the ban on gill nets. It's all over the internet and there are petitions to have the net ban reinstated. If this is allowed to go on, it will decimate our fisheries again

What I read was a little different...it was immediately appealed by the State which allows for continued enforcement.

So in fact..the ban is STILL in effect....well that's how I understand it.

Based on the legal events currently in process, FWC is exercising our discretion to not enforce the net limitation rules or regulations. Please see the attached memo Adobe PDF for more information.

This is the memo.

FROM: Colonel Calvin L. Adams, Jr.
DATE: November 1, 2013
SUBJECT: URGENT - Net Limitation Enforcement Directive
Below is an update regarding net limitation guidance for all law enforcement personnel.
Another order from the Circuit Judge in the Second Judicial Circuit is anticipated in the lawsuit regarding the use of entangling nets (Case # 2011-CA-2195) which would allow the use of nets originally prohibited under the Florida Constitution, but clear direction has not been provided by the court at this time. This memorandum is intended to provide necessary direction to our personnel until further information is received from the court.
Effective immediately, we will NOT be enforcing any of the following rules:
 FL Constitution Article X, §16
 FL Administrative Code rule 68B-4.002 (3) & (4)
 FL Administrative Code rule 68B-4.0081
 FL Administrative Code rule 68B-4.0082
 FL Administrative Code rule 68B-39.0047
 FL Statute 379.2422
 FL Statute 379.2423
We are appealing the final order and the anticipated ruling lifting the stay through the court system. This situation remains fluid and further guidance might be issued in short order.
As always, the same standards of excellence through fair and impartial judgment are to be expected. This is a very sensitive issue, and there is a great potential for confusion among fishermen and other members of the public.

This is all copy and pasted from FWC's site. This could turn into a disaster of epic proportions. Even of it only last say a few weeks the free for all could take years to rebound.

I am slowly building up my inshore fishing charter business, and this could completely devastate all the work I've done in a matter of weeks.

Well I'm corrected....the stay I referred to was lifted by Fulford last week. Nice.

I'm reading on some other sites that FWC succeeded in their appeal, and the ban will continue to be enforced. I haven't found anything in writing yet on FWC's site, but I'm looking.

"Well, gillnetters fun time is over, at least for now. The First District Court of Appeal just entered a stay of Judge Fulford's order. The first round is won and hopefully FWC officers will immediately do their duty. This fight is not over so keep those phone calls coming in and please sign the petition. Chester Brewer"

Looks like there has been a stay(temporarily) on the lifting of the net ban
